Trackster Terms of Service
Effective date: October 20, 2026
This document is for informational purposes and is not legal advice. Consult an attorney before relying on these terms.
1. Acceptance of Terms
These Terms of Service (the “Terms”) form a binding agreement between you and Trackster LLC, the operator of Trackster (“Trackster,” “we,” “us,” or “our”). By creating an account, purchasing a subscription, or accessing or using the app or related services (collectively, the “Service”), you acknowledge that you have read, understood, and agree to these Terms.
If you use the Service for a business or other organization, you represent that you have authority to bind that organization, and “you” includes both you and that organization. If you do not agree to these Terms, do not use the Service.
2. Description of Service
Trackster provides tools for lawn care and field-service businesses, which may include customer and job management, scheduling, route planning, mileage and time tracking, estimates, invoices, payment-status records, weather information, inventory tools, calendar features, and integrations with compatible third-party services.
Features may be added, changed, suspended, or discontinued at any time. The Service does not perform lawn care work, collect debts, provide banking or payment-processing services, or replace professional accounting, tax, legal, safety, or business advice.
3. User Accounts and Security
You must provide accurate, current information and keep it updated. You are responsible for all activity under your account, for maintaining the confidentiality of your credentials, and for ensuring that each person who uses your account is authorized to do so.
You must promptly notify us at tracksterllc.team@gmail.com if you suspect unauthorized access, loss of credentials, or another security incident. We are not liable for losses caused by your failure to protect your account, devices, credentials, or access permissions. We may require credential changes or suspend access when reasonably necessary to protect the Service or its users.
4. Subscription Plans and Billing
Free basics
Free — core features; premium features limited to 20 uses per month each (route planning, mileage tracker, route optimizer)
Solo plan
$15 per month
Crew plan
$35 per month (up to 10 seats)
Unlimited plan
$45 per month (10+ seats)
New subscriptions include a 30-day free trial with full access to all paid features; billing begins after the trial ends unless canceled.
Automatic renewal. Paid subscriptions automatically renew each month at the then-current price unless canceled before the next renewal date. You authorize Trackster and, where applicable, the app store or payment provider to charge your selected payment method for subscription fees and applicable taxes.
Cancellation. You may cancel at any time through the place where you purchased the subscription or through any cancellation method we make available. Cancellation stops the next renewal; access to paid features continues through the end of the current paid billing period.
No refunds. Except where required by law, payments are final and non-refundable. There are no refunds or credits for partial months, unused time, plan changes, or canceled subscriptions. Store or payment-provider refund rules may also apply.
We may change prices or plan features with advance notice as required by law. If a charge fails, we may retry the charge and suspend or downgrade paid access until payment is received. You are responsible for keeping billing information current. Any trial or promotion is subject to its stated terms and may be modified or withdrawn as permitted by law.
5. Acceptable Use
You may use the Service only for lawful business purposes and in accordance with these Terms. You may not:
- use the Service for unlawful, fraudulent, deceptive, abusive, harassing, or harmful activity;
- upload malware or content that infringes privacy, intellectual-property, or other rights;
- access another person's account or data without authorization, probe security, bypass access controls, or interfere with the Service;
- reverse engineer, decompile, disassemble, copy, scrape, mirror, or attempt to derive source code, algorithms, or non-public components of the Service, except to the limited extent applicable law expressly permits;
- resell, sublicense, rent, or commercially exploit the Service except as expressly authorized by us;
- use automated means in a manner that creates an unreasonable load or disrupts other users; or
- use the Service to send spam or unlawful communications, or to process information you do not have a lawful right to use.
You are responsible for your employees, crew members, contractors, and other authorized users and for their compliance with these Terms.
6. Intellectual Property
The Service—including its software, design, text, graphics, workflows, features, trademarks, and all related intellectual property—is owned by Trackster or its licensors and is protected by law. Subject to these Terms and payment of applicable fees, Trackster grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service for your internal business purposes.
Your data remains yours. As between you and Trackster, you retain ownership of information and content you submit to the Service (“User Data”). You grant Trackster a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and otherwise use User Data only as reasonably necessary to operate, secure, maintain, improve, and provide the Service, comply with law, and enforce these Terms. You represent that you have all rights and permissions needed to provide and use User Data.
If you submit feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.
7. Warranty Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TRACKSTER DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, compatible with every device, or that defects will be corrected. We do not guarantee the accuracy or completeness of invoices, estimates, routes, mileage, schedules, weather information, time records, taxes, financial records, customer details, calculations, or other outputs. Beta, preview, experimental, or pre-release features may be incomplete, may contain bugs, and may be changed or discontinued without notice.
No advice or information from Trackster creates a warranty not expressly stated in these Terms. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRACKSTER AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, BUSINESS, BUSINESS OPPORTUNITY, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF TRACKSTER AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL SUBSCRIPTION FEES YOU PAID TO TRACKSTER FOR THE SERVICE DURING THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not exclude liability that cannot lawfully be excluded or limited. Your sole remedy for dissatisfaction with the Service is to stop using it and cancel your subscription.
9. Data Accuracy Disclaimer
Trackster is a record-keeping and workflow tool, not certified accounting, bookkeeping, payroll, tax, legal, navigation, or financial software. It does not determine whether an invoice is legally enforceable, whether a route is safe or optimal, whether a tax rate is correct, or whether a business record satisfies legal or professional standards.
You are solely responsible for reviewing and verifying all data, calculations, totals, routes, mileage, taxes, invoices, estimates, reports, exports, and financial records before relying on, sending, filing, or using them. Maintain appropriate source documents and consult a qualified accountant, tax professional, attorney, or other adviser for matters requiring professional judgment.
10. User Responsible for Backups
You are responsible for maintaining current, independent backups of User Data and business records outside the Service. Export or otherwise preserve important records regularly and before canceling or closing an account. To the fullest extent permitted by law, Trackster is not responsible for loss, corruption, alteration, unauthorized access, or inability to retrieve User Data.
11. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Trackster and its owners, affiliates, officers, employees, agents, contractors, licensors, and service providers from and against third-party claims, demands, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use or misuse of the Service; (b) User Data; (c) your invoices, estimates, services, business operations, employees, contractors, or customers; (d) your violation of these Terms or applicable law; or (e) your infringement or violation of another person's rights.
We may control the defense and settlement of an indemnified claim, and you agree to cooperate. You may not settle a claim in a way that admits liability by, or imposes obligations on, Trackster without our prior written consent.
12. Third-Party Services
The Service may depend on or connect with third-party products and services, including Google Firebase, Gmail, Google Maps, Garmin, Stripe (payment links), app stores, device platforms, weather providers, and other integrations. Those services are operated by third parties under their own terms and privacy practices.
Trackster does not control and is not responsible for third-party availability, accuracy, security, acts, omissions, data handling, fees, changes, outages, compatibility, or content. A third party may modify, restrict, or discontinue access at any time, which may affect Trackster features. Your use of third-party services is at your own risk and may require separate accounts, permissions, or fees.
13. Termination
You may stop using the Service and terminate your account or subscription at any time. Subscription cancellation is governed by Section 4 and does not entitle you to a refund except where required by law.
We may suspend, restrict, or terminate access immediately if you breach these Terms, fail to pay fees, create security or legal risk, misuse the Service, or if continued service is no longer commercially or technically feasible. Where practical, we may provide notice and an opportunity to cure, but we are not required to do so when immediate action is reasonably necessary.
Upon termination, your license ends and you must stop using the Service. You should export User Data before termination. We may delete or de-identify User Data after termination in accordance with our retention practices and legal obligations, and we do not guarantee post-termination access or recovery. Sections that by their nature should survive—including ownership, disclaimers, liability limits, indemnification, dispute resolution, and payment obligations—will survive.
14. Binding Arbitration; Jury and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing a claim, either party must send written notice describing the dispute and requested relief to the other party and allow 30 days for a good-faith attempt to resolve it. Notices to Trackster must be sent to tracksterllc.team@gmail.com.
Individual arbitration. Except for qualifying small-claims matters or claims seeking injunctive relief for misuse or infringement of intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs this arbitration agreement. Arbitration may occur by video, telephone, written submission, or in person in Des Moines County, Iowa, unless the AAA rules or applicable law require another location. The arbitrator may award the same individual remedies available in court and will issue a reasoned written decision.
No jury trial. YOU AND TRACKSTER WAIVE THE RIGHT TO HAVE A JUDGE OR JURY DECIDE A COVERED DISPUTE IN COURT.
No class actions. YOU AND TRACKSTER AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION. Unless both parties agree in writing, the arbitrator may not combine claims or preside over any class, collective, consolidated, mass, or representative proceeding.
Fees. Arbitration fees will be allocated under the AAA Consumer Arbitration Rules and applicable law. Each party bears its own attorney's fees unless applicable law, the AAA rules, or another provision of these Terms permits an award.
30-day right to opt out. You may opt out of this arbitration agreement by emailing tracksterllc.team@gmail.com within 30 days after you first accept these Terms. Your notice must state that you are opting out of arbitration and include your full name and the email address associated with your Trackster account. Opting out of arbitration does not affect the rest of these Terms.
If the class-action waiver is found unenforceable as to a particular claim or request for relief, only that claim or request will proceed in a court of competent jurisdiction after all arbitrable claims are resolved. If AAA cannot administer the arbitration, the parties will select a comparable provider; if they cannot agree, a court may appoint one. This Section survives termination.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 14. For disputes not subject to arbitration, you and Trackster consent to the exclusive jurisdiction and venue of the state courts located in Des Moines County, Iowa, and the applicable federal court with jurisdiction over Des Moines County, Iowa. Nothing in this Section limits rights you may have under mandatory consumer-protection laws.
16. Age Requirement
You must be at least 18 years old and legally capable of entering a binding contract to use the Service. The Service is not directed to children. You may not allow a person under 18 to create an account or use the Service without direct supervision and only where permitted by law.
17. Claim Deadline
To the fullest extent permitted by law, any claim or cause of action arising out of or relating to the Service or these Terms must be filed within one year after the claim arose, or it is permanently barred. This limitation does not apply where applicable law prohibits shortening the limitations period.
18. Force Majeure
Trackster will not be liable for delay, interruption, or failure caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, epidemic, war, terrorism, civil unrest, labor disputes, governmental action, utility or telecommunications failure, cyberattack, internet or cloud-service outage, third-party platform failure, equipment failure, or acts of God.
19. Attorney's Fees
To the extent permitted by applicable law and consistent with the AAA Consumer Arbitration Rules, the prevailing party in an action or proceeding to enforce these Terms may recover reasonable attorney's fees and costs. This provision does not require a consumer to pay fees where applicable law or arbitration rules prohibit such an award.
20. Severability and Waiver
If any provision of these Terms is held invalid, illegal, or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full force. The special severability terms in Section 14 control arbitration and the class-action waiver. A failure to enforce any provision is not a waiver of the right to do so later.
21. Changes to Terms
We may modify these Terms from time to time. We will provide notice of material changes through the Service, by email, or by another reasonable method before the changes take effect when required by law. The updated Terms will state a new effective date.
Your continued use of the Service after updated Terms take effect constitutes acceptance of those changes. If you do not agree, you must stop using the Service and cancel before the changes take effect. Changes to Section 14 will not apply retroactively to disputes of which we had actual notice before the change took effect.
22. Entire Agreement; Assignment
These Terms, together with any plan terms, order terms, and policies expressly incorporated by reference, are the entire agreement between you and Trackster regarding the Service and supersede prior or contemporaneous agreements and communications on that subject.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. Headings are for convenience only. “Including” means “including without limitation.” Electronic communications and acceptance satisfy any writing requirement to the extent permitted by law.
